Firm partner Eric Lasker serves on expert panel on FDA preemption at national conference of medical device manufacturers.

As part of an expert panel organized by AdvaMed, the American Health Lawyers Association and the Washington Legal Foundation, Firm partner Eric Lasker took part in a vigorous debate on the bases for and future of the preemption defense in medical device and prescription drug litigation with co-panelists David Frederick (counsel for plaintiffs in Wyeth v. Levine) and Gerald Masoudi (former Chief Counsel, FDA).  Mr. Lasker provided the defense perspective in support of preemption and provided practical guidance for medical device manufacturers on business and regulatory practices that can maximize their prospects of meaningful preemption arguments should product liability litigation emerge.
