After just over two hours of deliberation, an 11-person jury in the Western District of Kentucky (Bowling Green), returned a unanimous verdict in favor of Novartis Pharmaceuticals Corporation following a three-week trial.  In Kyle v. Novartis Pharm. Corp., 1: 06-cv-00035-TBR (W.D. Ky 2012), the daughter of decedent Pamela Kyle alleged that the drug Zometa caused her mother to develop ONJ.  Pamela Kyle’s oncologist prescribed Zometa to prevent painful and debilitating bone damage due to her breast cancer that had metastasized to her bones.  Plaintiff claimed that Novartis failed to warn that Zometa could cause ONJ.  The jury found that Novartis provided an adequate warning.
