- Through her ability to develop and advance key legal arguments while also handling the many day-to-day details inherent in large-scale matters, Olivia Sacks has established herself as a skilled advocate and strategic case manager in high-stakes pharmaceutical and products liability litigation.
- Olivia brings clarity and momentum to high-stakes pharmaceutical and products liability litigation through compelling, well-crafted arguments and has authored a wide range of dispositive and procedural motions across all phases of litigation, including at the appellate level.
- For example, during the bellwether discovery process in the fast-paced, complex Tepezza® MDL proceeding, Olivia successfully drafted and argued the motion to dismiss for failure to state a claim that resulted in the full dismissal of one bellwether plaintiff’s case. She also drafted successful motions to dismiss all of the bellwether plaintiffs’ design defect claims and partial dismissals of the bellwether plaintiffs’ fraudulent misrepresentation claims.
- Olivia has extensive experience in achieving successful results for her clients in other aspects of their cases e.g., she is skilled at deposing fact witnesses, has sat second chair defending multiple corporate witness depositions, and has participated in all phases of expert discovery. That experience includes helping experts prepare for their depositions, drafting cross-examination of plaintiffs’ expert witnesses, and drafting motions and preparing for hearings on key scientific issues under FRE 702.
- Olivia also is co-author of the recently published guide to using the learned intermediary doctrine at all stages of litigation and how to counter plaintiffs’ anticipated responses.
