Firm partner Eric Lasker addressed DRI’s 2026 Drug and Medical Device Seminar in Boston, MA. The session — “Raising the Bar on Experts: Litigating Under Amended Rule 702 in Drug & Device Cases” — examined how amended Rule 702 is reshaping expert admissibility. The panel broke down recent federal and state decisions excluding expert testimony, examined the growing alignment of state evidentiary rules with the federal standard, and offered practical strategies for challenging unreliable or unqualified experts.

The program also explored how these developments are influencing case strategy more broadly, from Rule 702 briefing to trial preparation. Panelists highlighted emerging trends in judicial gatekeeping, including courts’ increasing focus on methodological rigor and the sufficiency of an expert’s factual foundation. Attendees were presented a clear understanding of how to anticipate and address Rule 702 challenges in a rapidly evolving legal landscape, as well as insights into how these shifts may shape expert-intensive litigation in the future.
