At the 2026 DRI Drug and Medical Device Seminar in Boston, Hollingsworth LLP associate Sebastian Ovalle and his co-panelist presented on the latest A.I. litigation trends in the U.S. and internationally. The discussion included how courts and regulators are confronting the rapid integration of A.I. into everyday life in ways that vary from chatbots to ride-sharing platforms. They addressed recent U.S. case law, including Garcia v. Character Techs., Inc., 785 F. Supp. 3d 1157 (M.D. Fla. 2025), that finds certain A.I. chatbots should be treated as a product, not as a service. They also outlined the key factors courts consider when deciding whether to allow traditional products liability claims against A.I.-related assets to proceed and what the consequences of this and similar decisions might be.
