Hollingsworth LLP’s Robert Johnston and Louis Russo recently spoke on Deposing Opponents’ Experts in Personal Injury Cases: Preparation, AI Tools, Goals, and Techniques in a 90-minute Barbri/Strafford webinar. The panel discussed how trial lawyers should prepare in order to be ready to attack the experts’ qualifications, prior opinions, and testimony.

Topics discussed included preparing to attack the expert’s qualifications; deciding how to use AI tools; attacking the expert’s methodology at deposition; identifying areas where the expert is unprepared; and setting up testimony for use in FRE 702 motions or Daubert challenges. They also addressed eliciting, from even seasoned expert witnesses, favorable testimony and admissions for impeachment, disqualification, exclusion of testimony, or leverage for settlement negotiation.
