Hollingsworth LLP Wins Summary Judgment for Sherwin-Williams in Case Alleging Asbestos Exposure

news | October 27, 2026

On October 8, 2026, the Alameda County Superior Court in California granted summary judgment as to all claims against defendant The Sherwin-Williams Company in the case Dole v. Bayer Consumer Care Holdings LLC, No. 25CV123904.

The plaintiff in Dole alleged exposure to asbestos or asbestos-contaminated talc from over 20 defendants’ products caused her malignant peritoneal mesothelioma. As to Sherwin-Williams, the plaintiff alleged exposure to asbestos fibers from sanding Sherwin-Williams paint products during a home renovation project in the late 1970s. After extensive briefing and oral argument, the court found that Sherwin-Williams successfully demonstrated that plaintiff’s exposures to Sherwin-Williams paints were not a substantial factor in causing her disease and, conversely, plaintiff failed to present admissible evidence to create a triable issue of fact regarding substantial causation. Sherwin-Williams is represented by Hollingsworth LLP attorneys Eric Lasker, Marchello Gray, Kathryn Jensen, Kyle McWaters, and Olivia Sacks. Marchello Gray handled the oral argument.
