Hollingsworth LLP partners Steve Klein and Don McMinn are the authors of the chapter “Insurance Recovery for Environmental Liabilities” in the book, Environmental Litigation: Law and Strategy (2009), newly published by the American Bar Association and its section of Environment, Energy and Resources Law. The chapter draws upon our lawyers’ extensive experience with insurance litigation on behalf of corporate policyholders since the outbreak of the environmental-coverage litigation wars in the 1980s and the practical experience of the firm in defending toxic-tort, environmental clean-up, hazardous-waste, and natural-resource damages claims across the country. The “Insurance Recovery” chapter surveys the state of the law and provides strategies for recovery by policyholders of general-liability insurance policies as well as specialized policies for environmental impairment liability (EIL), pollution legal liability (PLL), and remediation cost-cap policies.
